Governing Law and Jurisdiction:
These Terms and Conditions shall be interpreted and governed in accordance with the Law of Contract in England and Wales, regardless of the impact of the European Union law. If the Company and the Customer agree to perform in England and Wales or Scotland, the High Court of England and Wales shall be the competent court of jurisdiction. If the Customer resides in the European Union or EFTA, the Company may, at its discretion, nominate the court of the Customer's member state to be the competent jurisdiction court under the Brussels Convention. If the Customer resides elsewhere, the Company shall have absolute discretion as to the competent court or jurisdiction.
Invalidity of Terms and Conditions:
The Company shall not be liable for any defects resulting from wear & tear, accident, improper use by the Customer, faulty or use of the Goods or Services not in accordance with the instructions or advice of the Company or the manufacturer.
